"Whether the facts as found suffice to render the plaintiff a `prevailing party' is a legal question reviewed de novo." Church of Scientology, 2 F.3d at 1513. Finally, a district court's determination that a party has prevailed for purposes of awarding attorneys' fees is reviewed for abuse of discretion. Id.
