COMMENT The gravamen of an Equal Pay Act claim (as distinct from a retaliation claim under the Equal Pay Act) is that the plaintiff was paid less than male employees for equal work. Therefore it would seem impossible for a jury to find that the defendant violated the plaintiff’s rights under the Equal Pay Act and yet the plaintiff is entitled only to nominal damages. Accordingly, no instruction is included.
