Pertinent History:

1. October 13, 2022 marked the date of the last discrete act of discrimination from Respondent #1.

2. 291 days later – on July 31, 2023 – I filed my employment complaint of discrimination (see first attachment).
a. Pursuant to 29 CFR 1640.2, it was dual-filed
i. with the EEOC; and
ii. with the FCHR (a FEPA)).
3. On August 3, 2023, the FCHR confirmed that they had ‘actually received’ (60Y-5.001(3) FAC) my discrimination charge (see second attachment).

Importance:

4. According to 60Y-10.004 FAC, these respondents had 25 days to file an answer to my complaint.

5. Monday, August 28, 2023 marked the deadline for any such answer(s) (Rule 6 Fed. R. Civ. P., Rule 2.514 Fla. R. Jud. Admin.).

6. As of today’s date (9/5/23), no such answers have been delivered to me (ie, the plaintiff).

Additional Note:

7. Please take note that one of the charged respondents is the FCHR itself (ie, the state agency that’s [supposedly] combatting discrimination).

8. The FCHR is a co-defendant due to:
a. Its penchant for accepting bribes;

b. Its penchant for obstructing justice (ie, intentionally mailing determination letters to the wrong people; determinations which were null & void);

c. Its history of ratifying government-borne perjury;

d. Its adherence to self-discrimination;

e. Its committed purpose of saving defendants “millions” of dollars (when faced with discrimination suits);

f. Its support of the other defendants by subverting the US Constitution – while acting under the “color of law” (Ku Klux Klan Act of 1871); and

g. more
9. As of today’s date (9/5/23), no such answers have been delivered to me (ie, the plaintiff).

Hello Director Costilla,

Your intake/investigation department has failed to tell me what my case number is. Moreover, no one from your agency has notified me of the dual-filed nature of my charge (please see §2E, 2023 Workshare Agreement). Nor has anyone disclosed what answer any of the respondents [of my case] have proffered.

This dereliction of duty:
(i) violates state law (§760.11(3) FS); and
(ii) violates state regulation (60Y-5.0011(1) FAC).

The FCHR has violated its 2023 Workshare Agreement with you.

Facts

1. he statewide agency’s done so by failing to notify me (ie, “the Charging Party”) of the dual-filed nature of my charge.

2. It’s had two months to do so, yet – despite receiving multiple inquiries from me – it’s [apparently] refused to provide me [even] basic case information.

Legal Application

3. According to §2E of the 2023 Workshare Agreement, the FCHR was supposed to notify me within 10 days of receiving my complaint (attached).

4. Obviously, the FCHR has broken that agreement, because [much] more than 10 days have passed (please see 60Y-5.0011(1) FAC).
a. In fact, roughly 58 days have passed since they received it.
5. The state agency’s dereliction of duty has even violated state law (§760.11(3) FS).

6. Moreover, there are no legally-viable/reasonable excuses for the FCHR’s failure/refusal to provide me basic case information.

Hello EEOC Liaison Hernandez,

The FCHR has apparently lied about transmitting my dual-filed complaint to your agency.

For the time being, may you please just confirm that the FCHR has not sent you my charge of employment discrimination (against Redacted Company A, et al)?

Quick History:

1. On July 31, 2023, I dual-filed my charge of employment discrimination (attached).

2. On August 3, 2023, the FCHR’s investigator confirmed ‘actual receipt’ (please see 60Y-5.001(3) FAC).

3. On September 5, 2023, I asked the FCHR (a statewide FEPA) for a status update*.

4. On September 13, 2023, I asked the FCHR to tell me what my case number was/is*.

5. On September 28, 2023, the FCHR’s executive director told me that my complaint “was sent to the Atlanta District Office for processing”.
a. That same day, she told me to contact the Atlanta District Office.
6. As of today’s date (10/5/23), the EEOC’s database still does not have record of my complaint.

7. As of today’s date (10/5/23), the FCHR has failed to disclose my case number(s).

8. Earlier today – October 5, 2023 – the EEOC’s Atlanta District Office told me to contact you (ie, the Miami District Office) and the FCHR.

9. Earlier today – October 5, 2023 – the FCHR failed to relay pertinent information (neither via phone nor email).

*I’ve called/emailed multiple times since then
Please take into consideration that I’ve already lost two-months of administrative/investigative intervention. Intervention afforded me by statute (ie, §760 FS, Title VII, etc.) and regulation (ie 60Y-5 FAC, 29 CFR 1600 et seq). Moreover, the defendants – for whom the FCHR is protecting with its obstruction – have a statutory right to address my discrimination charge prior to getting sued.

So, please answer by 12:00 PM EST tomorrow (10/6/23).

Important note: if I don’t hear from you by then (either via phone/email) then I’ll have to pursue the next phase (ie, contacting higher authorities – please see Section 6 of the 2023 Workshare Agreement) under the operative conclusion that the answer is “yes” (see above question; repeated below for convenience:).

1. Last Monday (10/16/23), the Atlanta District Office intimated that it was going to try to use a different filing date.
a. A crucially different filing date [of October 11, 2023].

b. A filing date that would have rendered my complaint late.
2. A couple hours later, though, the Atlanta District Office told me (via phone) that it was going to indeed use my July 31, 2023 filing date.
a. Apparently, the office only did so because I had contacted you.
3. Plus, it said that it was going to move forward with investigating my complaint.

4. A few days later, though – on October 19, 2023 – the Atlanta District Office transferred my complaint to the Savannah Local Office.
a. Thereby reneging on its prior commitment to investigate my complaint (ie, #3 above).
5. Subsequent communications suggest that the EEOC is indeed trying to use an invalid filing date
a. Invalid Date ≈ 10/11/23
b. Correct Date = 7/31/23
6. Jane Suk, the EEOC Liaison (at the Atlanta District Office), has taken an abrupt 1-week vacation

7. No one at the Savannah Local Office has ever answered the phone
a. Nor has anyone ever returned my voicemails
8. No one at the EEOC has answered my above-listed question (ie, whether the EEOC is still crediting July 31, 2023 as the filing date of my employment discrimination complaint).

Underlying Facts

9. On October 13, 2022, the defendant committed its last discrete act of employment discrimination1

10. On July 31, 2023,2 I dual-filed3 my discrimination complaint
1 the last known act
2 July 31, 2023 was 291 days after the last discrete act (ie, #1 above). 291 days satisfies the 300-day criteria for dual-filing (Florida).
3 filed with [and confirmed by] the FCHR (a statewide FEPA).

Bottom Line

11. The EEOC is trying to railroad me.
a. It’s doing so by using an invalid filing date in order to impede my constitutional right to a full-&-fair opportunity to litigate my discrimination case
i. Apparently, it’s motivated by its desire to help cover for the statewide FEPA (ie, the FCHR) – who initiated this obstruction

Law

12. According to §2E of the 2023 Workshare Agreement, the FCHR was supposed to notify me within 10 days of receiving my complaint (attached).

13. Obviously, the FCHR has broken that agreement, because [much] more than 10 days have passed (please see 60Y-5.0011(1) FAC).
a. In fact, roughly 86 days have passed since they received it.
14. Moreover, several federal regulations state that the FCHR/EEOC must notify me within 10 days of receiving my complaint
a. 29 CFR §1641.5(d)
b. 29 CFR §1691.5(c)
c. 29 CFR §1691.6(d)
15. The state agency’s dereliction of duty has even violated state law (§760.11(3) FS).

16. Moreover, there are no legally-viable/reasonable excuses for the EEOC’s/FCHR’s failure/refusal to provide me basic case information.

Your staff’s been refusing to answer this question (for the past two weeks). Yet it’s paramount to my forthcoming lawsuit (against Redacted Company A, et al). Altogether, your staff – in apparent efforts to cover for a state FEPA (ie, the FCHR) – is trying to obstruct my access to justice. And their obstruction is damaging me severely.

Details

I finally got an answer to this question (just a few minutes ago – please see first attachment). So, you won’t have to respond to my earlier email (from below).
➢ Nevertheless, may you please have your staff take punitive action(s) against the Florida Commission on Human Relations?
As my research (and this experience) has revealed, the FCHR has a pattern & practice of subverting justice. In the past, it’s done so by ratifying perjury, intentionally mis-mailing crucial documents, discriminating against its own commissioners, and much more. The state FEPA even has the statutory ability to accept bribes.

As a pressing example, the FCHR has recently tried to make an employment discrimination complaint disappear. It’s even lied to try to effectuate that lawlessness (please see email from 10/9/23). Apparently, the FCHR’s even commandeered your EEOC-FCHR Liaison (ie, Frank Hernandez) to accomplish it (evidence forthcoming).

Quick History:

1. On July 31, 2023, I dual-filed my charge of employment discrimination (second attachment).

2. On August 3, 2023, the FCHR’s investigator confirmed ‘actual receipt’ (please see 60Y-5.001(3) FAC).

3. On September 5, 2023, I asked the FCHR (a statewide FEPA) for a status update*.

4. On September 13, 2023, I asked the FCHR to tell me what my case number was/is*.

5. On September 28, 2023, the FCHR’s executive director told me that my complaint “was sent to the Atlanta District Office for processing”.
a. That same day, she told me to contact the Atlanta District Office.
6. On October 5, 2023, however, two EEOC employees informed me that the EEOC’s database still did not have record of my complaint.
a. Thereby debunking the false statement (ie, lie) that the FCHR’s Executive Director proffered (#5 above)
7. On October 19, 2023, the EEOC notified me that it will not investigate my case
a. It gave no reason for the refusal to investigate

b. Thus, the FCHR’s obstructions have robbed me of an EEOC investigation
8. Today – November 11, 2023 – the EEOC finally told me that my 7/31/23 complaint was indeed timely.
a. In other words, it took 90+ days to get over the biggest/most-unnecessary hurdle
9. As of today’s date, though, additional obstructions exist.

10. Ultimate Fact: it took 93 days (and dozens of calls/emails) to get basic case information (ie, case number, filing date).
a. Information, importantly, that the FCHR lied about providing.

b. Information, importantly, that the FCHR had a legal obligation to provide.

As foreshadowed, here’s evidence of the FCHR commandeering its EEOC Liaison (Frank Hernandez) in order to effectuate its lawlessness.

Backdrop:

The FCHR’s lawlessness centered around its attempts to make my charge of employment discrimination disappear

Ultimate Fact:

EEOC Liaison Hernandez tried to cover for the FCHR’s lawlessness; doing so by:
(a) avoiding direct answers;

(b) avoiding phone calls; and

(c) proffering bogus information in order to obstruct/stall my pursuit of justice

Details:

1. On July 31, 2023, I dual-filed my charge of employment discrimination.

2. On August 3, 2023, the FCHR’s investigator confirmed ‘actual receipt’ (please see 60Y-5.001(3) FAC).

3. On September 5, 2023, I asked the FCHR (a statewide FEPA) for a status update.

7. On October 5, 2023, however, two EEOC employees informed me that the EEOC’s database still did not have record of my complaint.
a. Thereby debunking the false statement (ie, the lie) that the FCHR’s Executive Director proffered (#6 above)
8. That same day, the EEOC’s Atlanta District Office advised me to contact the EEOC Liaison in Miami (ie, Frank Hernandez).
a. So, I did.
9. On October 5, 2023, I asked EEOC Liaison Hernandez to [essentially] confirm that FCHR Director Costilla had lied to me.
a. A simple confirmation, prudently, that was foretold/corroborated by two EEOC employees from the Atlanta District Office
i. I called multiple times

ii. Please see first attachment
10. That same day – yet a week after initial questioning (see #5 above) – EEOC Liaison responded by sending me information about the wrong case
a. Please see second attachment

b. Note: this ‘wrong case’ was a different case which FCHR Director Costilla has obstructed
i. An obstruction which I’m still battling – to this day.
11. So – hours later – I alerted EEOC Liaison Hernandez of his inaccuracies.
a. Mr. Hernandez, however, never replied.
i. Thereby never remedying his inaccurate/dilatory submission.
b. Thus, Mr. Hernandez’s crystallizing intentions helped the FCHR obstruct my case
12. Of course, it took an additional 26 days for me to finally get the EEOC to admit that my charge of employment discrimination was indeed timely.
a. In other words, it took 90+ days to get over the biggest/most-unnecessary hurdle
i. A hurdle erected by Cheyanne Costilla and Frank Hernandez

ii. A hurdle that would have heavily impaired my forthcoming lawsuit
13. The bottom line is that EEOC Liaison Hernandez engaged in obstructive/dilatory tactics to cover for FCHR Director Costilla’s law-violating efforts.

Formal Accusations:

14. I am hereby accusing Frank Hernandez (EEOC Liaison) of obstructing the proper administration of justice.

15. Also, I am hereby accusing Cheyanne Costilla (FCHR Executive Director) of obstructing the proper administrative of justice

16. Importantly, I am hereby accusing Ms. Costilla of subverting the EEOC-FCHR Workshare Agreement in order to steal federal funds.
