ITEM 5.1.3 | EXCLUSION FOR CLERK’S RESPONSIBILITIES
The FCTC recognizes that existing law establishes the clerks of court as the official custodians of courtrecords. Systems built and maintained by the clerks of court and limited to their historical functions are excluded from this definition. Specifically, general-purpose files, indexes, or document viewers made available by the clerk to users other than the judiciary and in-court participants are not subject to the functional requirements of this document, although they remain subject to all other FCTC policies and requirements, including but not limited to the Integration and Operability standards and all other requirements set forth by the Supreme Court. This standard does require the clerks of court to make their official court files available to the CAPS in read-only fashion in real-time or from a replication delayed no more than five minutes from real-time.
