Dear FCHR,

You broke state law today (Thursday, September 21, 2023).

This is the 2^nd time (in the past 15 months) in which you’ve broken the same law (see attachment #1).

Bottom line: You Cannot Hold Secret Meetings Regarding the Public’s Business.

Rule 28-109.004(2) FAC requires you to terminate any public meeting that prevents the public’s attendance (when such meeting is experiencing technical difficulties).

Factual History

Today – Thursday, September 21, 2023 – you held a public meeting (see 49 FAR 178).
That meeting suffered a technical difficulty.
That difficulty prevented the public [including myself] from attending the meeting.

I am an “interested person” (as indicated by 28-109.004 FAC; as well as the 1^st Amendment (US Constitution))

In fact, your staff knew about it (see Juan Collins, General Counsel; see electronic records).
However, you failed to terminate the public meeting.

Two members of your staff confirmed these facts (#1-5, supra) with me today (via phone).

Legal Application

This undisputed/indisputable factual reality violates state regulation (ie, 28-109.004(2) FAC). It also violates state law. Pursuant to §286.011(3) FS, the actions you took at today’s meeting are null & void.

Accordingly, may you please rescind all of the decisions that you made in today’s case disposition meeting; including – but not limited to – the following Final Orders:

Solution

Upon rescission, please reconvene the public meeting. Whereby legitimate decisions can be rendered (and observed).

Question: Do you agree to do this (rescission + re-convene)?

Please answer by 3pm EST today (Thursday, September 21, 2023).

If you don't provide agreement by that deadline (via email and/or phone) then I'll be forced to take action.

First Footnote: I’ve begged you to obey the law on numerous occasions. Yet – despite having ample opportunity to act in good faith – you’ve carried out your transgressions to the detriment of others.
Second Footnote: these case deliberation meetings are important. On June 27, 2019, your former attorney ratified perjury during such a meeting. As you know, he’s been named as a defendant in a civil rights action (under 42 USC §1983 – ‘Ku Klux Klan Act of 1871’)
Fourth Footnote: given the fact that a rapid correction will prevent wasting additional judicial/administrative resources, I’m keeping a tight deadline (ie, same day response required).
Fifth Footnote: reconvening this meeting should be quite easy; as the meeting only takes 5-10 minutes; and the underlying material has not perished
Final Footnote: I’ve cc’d the petitioners from each of your infected Final Orders (including the petitioners that you previously disenfranchised [in June 2022]).
